Terms & Conditions

Last updated: 1 January 2025

1. Agreement to Terms

By accessing this website or engaging TrakSyn Outbound ("TrakSyn", "we", "us") for services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.

2. Services

TrakSyn provides B2B outbound sales and lead generation services, including but not limited to cold email campaigns, LinkedIn outreach, lead research, email infrastructure setup, and appointment setting. The specific scope of services for each client is defined in a separate Service Agreement or Statement of Work.

3. Engagement and Payment

All engagements are subject to a minimum three-month initial term to allow campaigns sufficient time to ramp and deliver consistent results. Following the initial term, engagements continue on a rolling monthly basis and may be cancelled with 30 days' written notice.

Fees are charged as a flat monthly retainer with no setup fees, no per-meeting charges, and no hidden costs. Payment terms are outlined in your individual Service Agreement.

4. Client Obligations

To enable us to deliver our services effectively, clients agree to:

5. Results and Guarantees

Outbound performance depends on a range of factors, including market conditions, offer-market fit, and client responsiveness. While we apply proven systems and continuously optimise campaigns, we do not guarantee specific numbers of meetings, replies, or revenue outcomes. Any benchmarks or case study figures shared on our website represent past results and are not a guarantee of future performance.

6. Intellectual Property

All content on this website, including copy, design, and code, is the property of TrakSyn Outbound unless otherwise stated. Campaign assets (copy, sequences, lead lists) produced specifically for a client become the property of that client upon full payment of all outstanding fees.

7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed in the course of the engagement. This obligation survives the termination of any service agreement for a period of two years.

8. Limitation of Liability

To the maximum extent permitted by law, TrakSyn's total liability to any client for any claim arising from or related to our services shall not exceed the total fees paid by that client in the three months preceding the claim. We are not liable for any indirect, consequential, or loss-of-profit damages.

9. Termination

Either party may terminate the engagement after the initial three-month term with 30 days' written notice. TrakSyn reserves the right to terminate immediately if a client materially breaches these terms or fails to make payment within 14 days of a due date.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our website or services after any change constitutes acceptance of the updated terms.
